Argh, the inconsistencies ... oh well, since I got unsanitys Mex Menus, I do what I want anyway :) Perhaps it's mainly implemented in stuff with many windows, mail really has only one window usually (at least that's how I use it, Allan seems to have many), terminal though strikes me as a "window" application ... it's to bad this isn't controlled more centrally and consintently by Apple, at least in their own apps.
