Yes, I can't find it ATM, but somewhere in some Apple document it did state that if the user opens a file with an (unmodified) 'untitled' window open, the application should use this window for the newly opened document.
So best to open the file before pressing command-n.
Or just press space-backspace quickly, to make the file modified.
