Hopefully this isnt premature, but I think I've finally fixed this by
tweaking smb.conf

Just leaving it here incase other people have a problem in future..

[accounting]
case sensitive = yes

[data]
mangled names = no
mangle case = no

[global]
preserve case = yes
short preserve case = yes
````
